Former director of the U.S. Copyright Office, Shira Perlmutter, had a dose of reality after a federal judge gutted her attempts to reclaim her former job that she lost seemingly due to her hostile political inclinations.
U.S. District Judge Timothy Kelly upset her apple cart after ruling that she failed to prove irreparable harm after being fired by a Trump administration appointee. Like other deep state bureaucrats, Perlmutter believed she was not answerable to the President and that he had no right to end her employment.
She claimed that the Trump administration overstepped its boundaries by firing the Librarian of Congress, Carla Hayden, who had the sole responsibility of hiring or firing the director of the U.S. Copyright Office.
However, the Trump administration had appointed Deputy Attorney General Todd Blanche as acting Librarian, who approved Perlmutter’s sacking.
Nonetheless, the former copyright chief requested the federal judge to issue a temporary restraining order (TRO), barring Trump officials from firing the Librarian of Congress.
However, Trump’s Department of Justice lawyers argued that the Library of Congress was “part of the Executive Branch and is subject to presidential control.”
“The Library of Congress is not an autonomous organization free from political supervision,” they stated.
“The Constitution creates three branches of Government. There is Congress, the Executive, and the Judiciary. There is no fourth constitutional category reserved for an indeterminate-and-multiplying number of autonomous federal organizations. That simple principle suffices to deny Plaintiff’s motion,” they claimed.
Nonetheless, Democrats claim the Library of Congress is a legislative body and that Trump’s change of leadership amounts to encroachment by the White House.
However, the Trump administration argues for the legitimacy of the copyright chief’s termination, claiming it was approved by the acting librarian, who has the power to hire and fire.
“The President then removed Plaintiff, Shira Perlmutter, from service as the Register of Copyrights and Director of the U.S. Copyright Office — a decision that was ratified by Mr. Blanche in his role as acting Librarian, including through Mr. Blanche’s appointment of Paul Perkins to that role,” the filing said.
Ironically, the person on whom the former director of the U.S. Copyright Office hinges her job security is not fighting for her reinstatement, as she seemingly has accepted her fate. Nonetheless, a legal gray area exists, which seems to be working against the leftist copyright chief.
Her claim of irreparable harm also fell flat on its face as the Trump administration argued that she “has no right to perpetual service as Register of Copyrights.” That argument seems to have struck a chord with the federal judge, leading to the eventual dismissal of her request.
Meanwhile, the Librarian of Congress and the Director of the U.S. Copyright Office had been recommended for termination due to their alleged perpetration of harmful ideologies, including pushing for radical transgender ideology for children.
According to the American Accountability Foundation (AAF), the duo was a toxic and powerful proxy of the left, thus necessitating their removal for the success of Trump’s America First policy.
“It is time they show Carla Hayden and Shira Perlmutter the door and return an America First agenda to the nation’s intellectual property regulation,” said Tom Jones, the president of the AAF.
