GOP Congressman Moves To Impeach Activist Judge James Boasberg Without a Two-Thirds Majority

U.S. Rep. Andy Biggs (R-AZ) has filed an impeachment motion to remove Judge James Boasberg for breaching the “Good Behavior” by interfering with President Trump’s lawful directive and failing to disclose payments “from non-federal sources.”

The United States District Court for the District of Columbia judge blocked Trump’s deportation of over 200 alleged Tren de Aragua gang members to El Salvador and ordered their return. He also threatened to hold Trump officials in contempt for failing to return the gangbangers.

He argued that the deportees had the right to be heard on an individual basis to determine if they qualified as foreign enemies under the 1798 Alien Enemies Act, which Trump invoked on March 15, 2025.

“Plaintiffs are likely to succeed on equal fundamental theory: before they may be deported, they are entitled to individualized hearings to determine whether the Act applies to them at all,” he stated.

Subsequently, Rep. Biggs believes that Judge Boasberg is unfit to serve as a federal judge for interfering with foreign policy and national security for political purposes.

“James E. Boasberg knowingly extended beyond the bounds of power of his office and unjustly interfered in the execution of foreign policy and national security for partisan purposes of halting the implementation of the President’s foreign policy and for political gain,” Rep. Biggs stated.

“Furthermore, James E. Boasberg has failed to disclose payments received from non-federal sources and abused his discretion during his term on the Foreign Intelligence Surveillance Court,” for which the judge was appointed to serve a seven-year term in Feb. 2014.

While removing a federal judge requires a two-thirds majority in the Senate, Rep. Biggs plans to bypass the requirement by invoking Article III, Section 1 of the Constitution.

“His removal from office via impeachment, however, will undoubtedly be blocked by Democrats in the Senate, since it requires a two-thirds majority. My resolution, on the other hand, asserts, pursuant to Article III, Section 1, that rogue judges may be removed the same way we confirm them—by a simple majority,” he stated.

Nonetheless, Rep. Biggs asserted that Judge Boasberg “must not be permitted to remain in his position. Congress has a duty to fulfill the promises we’ve made to the American people, including defending the President’s authority to enforce our laws.”

Besides Rep. Biggs’s impeachment motion, other lawmakers have been sifting through Judge Boasberg’s records and conduct to identify any suspicious conduct and patterns.

Senator Eric Schmitt (R-MO) recently noted that Judge Boasberg was not the emergency assignment judge when he was assigned the TdA lawsuit, suggesting that he was tipped off and inserted himself into the case.

“How did Judge Boasberg get the TdA case when he wasn’t the emergency assignment judge on March 15? Did he use his position as Chief Judge to force himself onto the case? The American people are demanding answers. I’ll be filing legislation to require random case assignments,” Sen. Schmitt stated.

The GOP senator noted that federal Judge Boasberg was on vacation when anti-American ACLU and Democracy Forward filed the case at 2:30 am, yet somehow ended up handling the case.

“Somehow, he ended up with that case. He wasn’t the emergency judge on duty, so I think this requires further investigation and legislation,” he added. 

“The emergency judges 100% of the time get those cases. So he could have been tipped off that this was going to be filed, and while on vacation, he took the case.”

Somehow, Judge Boasberg was also “coincidentally” assigned the Signalgate case after a watchdog group filed the case. The Obama judge did not hesitate to issue a temporary restraining order on Thursday, requiring the administration to keep records and file a status on Monday. 

Boasberg also handled January 6 cases, further eroding the element of coincidence that somehow got him handling anti-Trump cases.

    The judge is corrupt as hell. REMOVE HIM!! Time and time again he has shown himself to be against Trump and the MAGA movement.

    It’s beyond time to start holding rogue, activist judges accountable, and make it easier to remove them when they rule on cases that are beyond their scope of authority.

    How is it that the SCOTUS requires 9 justices to rule on nationwide matters, like presidential Executive Branch ones, however a SINGULAR LOW LEVEL judge can issue a nationwide injunction against the President of the United States, who according to Article II of the Constitution, holds PLENARY POWER in matters of national security, immigration, and the military?!? One judge should not be able to rule on Article II Executive Branch matters. And Congress needs to get off their ARSES and tell all lower level judges that they have ZERO jurisdiction in Article II Executive Branch cases.
