Obama Judge Defies Trump,Rules 350,000 Illegals Cans Stay in U.S.

A federal judge appointed by former President Barack Obama has blocked the Trump administration’s decision to terminate Temporary Protected Status (TPS) for approximately 350,000 Venezuelans in the U.S.

U.S. District Judge Edward Chen of San Francisco issued a temporary injunction, halting the Trump administration’s effort to terminate temporary legal protections for 350,000 Venezuelans just a week before the protections were due to end.

Chen said in his ruling that TPS has broad implications for the nation, adding that terminating these protections could harm the U.S. economy.

Chen wrote:

“Court finds that the Secretary’s action threatens to: inflict irreparable harm on hundreds of thousands of persons whose lives, families, and livelihoods will be severely disrupted, cost the United States billions in economic activity, and injure public health and safety in communities throughout the United States.

At the same time, the government has failed to identify any real countervailing harm in continuing TPS for Venezuelan beneficiaries.

Plaintiffs have also shown they will likely succeed in demonstrating that the Secretary’s actions are unauthorized by law, arbitrary and capricious, and motivated by unconstitutional animus.

For these reasons, the Court grants Plaintiffs’ request to postpone the challenged actions pending final adjudication of the merits of this case.”

The injunction means Venezuelans may work in the United States and are protected from deportation, essentially disrupting part of Trump’s deportation efforts.

DHS Secretary Kristi Noem said her decision to terminate Venezuela’s TPS designation was due to there being members of the Tren de Aragua criminal gang among the TPS recipients.

Noem argues that her termination was part of the Trump administration’s broader crackdown on illegal immigration, adding that TPS exacerbated the border crisis.

She further noted that improved conditions in Venezuela, including better healthcare and lower crime rates, now allow a safe return for illegal immigrants.

In March, Democratic New York Attorney General Letitia James launched a legal challenge against Trump’s move to terminate TPS for Venezuelans.

James and a coalition of 17 state attorneys submitted an amicus brief in federal court, arguing against the Department of Homeland Security’s decision to end the protections.

The brief stated that over 600,000 Venezuelans in the United States hold TPS and that terminating it would lead to irreparable harm by revoking their legal work rights.
