Illegal Alien Who Murdered Laken Riley Secures Victory Toward a Lesser Sentence

The post-conviction defense team for the illegal alien who killed Laken Riley has made significant progress in having the prison sentence for the convicted killer reduced.

Riley was a 22-year-old Augusta University College of Nursing student killed by a Venezuelan illegal immigrant, Jose Ibarra, while jogging on the University of Georgia campus, which she had previously attended.

The Tren de Aragua suspected gang member was found guilty on various charges, including malice and felony murder, kidnapping with bodily injury, aggravated battery, aggravated assault with intent to rape, tampering with evidence, and being a peeping Tom. He waived his right to a Jury, allowing Clarke County Superior Court Judge Patrick Haggard to hear his case alone.

Earlier this month, the defense team pressed Judge Haggard to issue a retrial order, in which they plan to argue for reduced responsibility due to “congenital deficiency.”

According to the New York Post, Ibarra’s post-conviction attorneys argue that he suffers from “congenital deficiency which could render the client incapable of preparing a defense and standing trial.”

They also intend to prove that the alleged condition affected his judgment when he committed the crime and that he is incapable of understanding the proceedings, thus making him unfit for trial.

“[Our client] is suffering from a congenital deficiency which could render the client incapable of preparing a defense and standing trial,” they stated.

Subsequently, Judge Haggard ordered Ibarra to undergo a psychiatric evaluation at the Georgia Department of Behavioral Health and Developmental Disabilities (DBHDD) to determine if he was fit to stand trial. A Spanish translator will accompany him during the evaluation.

“The mental competence of [Ibarra] has been called into question, and this court has found it appropriate for an evaluation to be conducted at the public expense,” Judge Haggard wrote.

However, the court-ordered mental evaluation at “public expense” could cost taxpayers hundreds of thousands of dollars.

Meanwhile, Prosecutor Sheila Ross claims that the killer illegal immigrant showed no psychiatric concerns during his previous trials, and there were no indications that he could not withstand another. 

“There were no challenges or concerns about Defendant’s competency to stand trial during the pretrial and trial proceedings,” she wrote.

“Moreover, there is nothing in the trial record that would suggest that Defendant was not competent during his trial.”

However, Prosecutor Ross does not oppose the defendant undergoing a mental evaluation.

Riley’s murder inspired the Laken Riley Act, which requires the Department of Homeland Security (DHS) to detain illegal immigrants who have been arrested for burglary, theft, larceny, or shoplifting. Before the murder, Ibarra had been arrested twice, including for allegedly stealing merchandise alongside his brother. He was subsequently released pending a court appearance, but he failed to show up. 

The Act also allows state governments to sue the federal government for certain immigration decisions that endanger their residents or cause financial harm of over $100. Only 48 House Democrats supported the House bill, while 159 others opposed it. However, twelve Senate Democrats joined their Republican counterparts to pass the Senate bill, which was co-sponsored by Sen. John Fetterman (D–PA).

Like millions of other illegal immigrants that the Biden administration allowed into the country, Ibarra was released on parole after illegally entering the country through El Paso, Texas, in September 2022.

  1. Enough of this BS. Of course he is mentally ill, no one in their right mind would do what he did. It doesent matter. Put him to death for his actions.

  2. Put Ibarra in prison where he belongs. The inmates will happily end his “suffering from a congenital deficiency.” In all likelihood he’ll soon be suffering from a con genital surplus!

  3. Why would A (or several) psych evals cost taxpayer hundreds of thousands of dollars? It’s not rocket science to interview, test, and evaluate a patient. If the Psychiatrists and/or Psychologists are charging that much per hour – and really, how many hours can they possibly need? – they need to be investigated for fraud.
