The Trump administration has filed new federal charges against an illegal immigrant convicted of killing two American teens in a DUI incident after the soft-on-crime California decided to release him after barely serving a third of his sentence.
Oscar Eduardo Ortega-Anguiano was to be released in July after serving only 3.5 years of his two 10-year concurrent sentences. The illegal alien who had a lengthy rap sheet, including a traffic violation before the accident, was driving at 100mph under the influence of alcohol when he crashed into and killed 19-year-olds Anya Varfolomeev & Nikolay Osokin, who were dating.
Under California law, which prioritizes the welfare of criminals over the victim, the habitual lawbreaker is considered a “non-violent” offender and is eligible for an early release despite having killed two people.
On Easter, the California Department of Corrections notified the victims’ families that the illegal alien DUI killer would be released early on July 19, 2025. Distressed, they talked to the press about their disappointment, gaining nationwide attention. Subsequently, the Trump administration swung into action and filed felony immigration charges against the individual.
“My office has filed a felony immigration charge against this defendant. He faces up to 20 years in federal prison if convicted for 8 USC 1326. If the State of California will not seek the full measure of justice against this individual, the [DOJ] will,” Bill Essayli, United States Attorney for the Central District of California, posted on X.
“If the State of California will not seek the full measure of justice against this individual, the @TheJusticeDept will,” he added.
Meanwhile, the Governor of California Gavin Newsom said he will cooperate with immigration officials to transfer Ortega-Anguiano before his release, despite the state being a sanctuary for illegal immigration. “CDCR will again coordinate with ICE—as they have w/ 10,000+ inmates—to transfer him before release.”
However, California’s sanctuary law, especially the California Values Act (SB 54), prohibits sharing a prisoner’s release dates with ICE or honoring detainer requests after release. Local law enforcement agencies are also prohibited from investigating or arresting individuals for immigration enforcement.
Nonetheless, Border Czar Tom Homan has promised to work with the U.S. Department of Homeland Security Secretary Kristi Noem to deport the convicted DUI killer after his conviction.
Meanwhile, Orange County District Attorney Todd Spitzer slammed California Democrats for failing to address the soft-on-crime laws that allow criminals to walk free in the guise of inclusiveness, equality, and fairness. California is also among the 19 states that allow illegal immigrants to acquire driver’s licenses without checking their driving history in their home countries. Such individuals might have caused serious accidents at home or could even have been banned from driving, but liberal states just give them new licenses to continue the trend.
“Years of California’s crusade to put the rights of criminals over the rights of victims has resulted in the unimaginable pain inflicted on the grief-stricken parents … who had to be told that the man who killed their children … is considered a “non-violent” offender under California law,” Spitzer wrote.
“Killing two human beings while drunk is anything but non-violent.”
Spitzer also pointed out the irony that a drunk driver who injures somebody spends more time in prison than a DUI killer. He also lamented that the Democrat-led California legislature has killed all bills that would hold lawbreakers accountable for their actions.
“Instead of standing up for victims and preventing future victims, the state Legislature killed those bills. And on our roads people keep dying while their killers get nothing but a slap on the wrist.”
Killing two people is not considered violent in California.

The federal DOJ needs to have at least 100 law enforcement officers on site days before his scheduled release to make sure they don’t try to slip him out or release him before ICE arrives. If CA wants to play games, the feds can do it better.
